Searching Rutherford County Criminal Dockets
Start at the North Carolina eCourts Portal, which costs nothing to search. Smart Search inside it finds public Rutherford County criminal and infraction cases. Clicking the underlined case number opens the Register of Actions or Case Summary. Treat that view as a convenience. It is not the official court record. Anything that matters should be confirmed with the clerk. A case number is the sharpest search key. For names, the Portal guide says to enter them in Last, First order. Narrow a broad list rather than guess.
Smart Search wants a basic case number or name first. Its Advanced Filtering Options will respond only after that. Pick Rutherford as the location. Choose Criminal or Infraction as fits. Apply status, a date-of-birth range, or filing dates only to tighten a plausible result. Months and days of birth are masked in public results. The Portal caps results at 200, so refine a common surname rather than scroll. If nothing comes back, the trouble may be spelling. It could also be a restricted record, or a file that needs Rutherford Clerk review.
- Open Rutherford Smart Search and enter a record number or a Last, First name.
- Expand Rutherford filters, select Rutherford, and apply Criminal or Infraction when it fits.
- Refine the Rutherford result with a date range, status, or another documented criterion.
- Select the underlined Rutherford case number to open the public Register of Actions.
- Use Rutherford Search Hearings for a current setting and contact the Rutherford Clerk for an official copy.
Rutherford County Criminal Portal Filters
Filters tame a statewide Rutherford docket search without touching the underlying court record. The criminal category choices run from Criminal and Infraction to Out of State Probation. Out of State Parole rounds out the list. Status options include many labels. They are Pending, Disposed, Completed, Archived, Appealed–Appellate, Pending Expungement, Remanded, Transfer to Another County, Transferred to Superior Court, and Voluntarily Dismissed with Leave. A status is just the system's current classification. It does not replace the event history or a Rutherford Clerk confirmation of the case record.
Keep the Portal and File & Serve separate in your mind. File & Serve handles electronic filing for attorneys and filers. It is not the public reader for a Rutherford criminal docket. Hunting there for a Case Summary wastes time.
The official File & Serve route appears here for a reason. It is distinct from the Portal's public search.
For a Rutherford County criminal docket lookup, go back to Smart Search and open the Case Summary after you pull up a record.
Inside a Rutherford County Criminal Docket
Open the Rutherford Case Summary through its linked case number. Then use its menu to browse the filled sections. Case Information and Assignment Information identify the record and its division. Party Information shows only what public display law allows. Victims never appear in Portal results. Case Events supply the dated public chronology. Hearings, Dispositions, and Financial Information show up when data exists. A blank block does not prove the case lacks a hearing or balance.
| Record number | Use the exact Rutherford Portal or notice identifier; an example legacy format is 01CR123456-100, not a required format for every current case. |
|---|---|
| Assignment | Shows whether the public Rutherford record is in District Court or Superior Court when populated. |
| Case Events | Public Rutherford chronology can include filings, process, hearing actions, orders, and status changes. |
| Hearings | Shows populated setting information; Rutherford Search Hearings better verifies a current date. |
| Dispositions | Separates pending, disposed, transfer, remand, appeal, or pending-expungement status. |
Public Rutherford documents appear only when they are both public and uploaded. Each one downloads separately. A large file that throws an error may need the Rutherford Clerk to split it into smaller pieces.
Rutherford County Criminal Docket Codes
North Carolina's AOC-CR-314 code key offers statewide shorthand for reading a Rutherford record, though not every Portal screen uses the same terms. CR stands for Criminal District Court. CRS means Criminal Superior Court. F, M, and I mark felony, misdemeanor, and infraction. The key also defines DC as dismissed by court, DD as dismissal or deferred prosecution, GU and GL as guilty to the charged or a lesser offense, and NG as not guilty.
- PJ
- Prayer for Judgment Continued, a North Carolina disposition or sentencing-related term.
- PROB / REST / SENT
- Probation, restitution, and imposed sentence in the official code key.
- VD / VL
- Voluntarily dismissed without leave or with leave, with the latter subject to the form’s reinstatement note.
Read any code alongside the surrounding Rutherford events and orders. A two-letter entry cannot reveal every condition or later action in a case.
How a Criminal Case Moves
A Rutherford criminal file can open in several ways. A citation, warrant, criminal summons, indictment, information, or other process may start it. From there the Register of Actions may show first appearances, probable-cause work, bond action, arraignment, a plea, motion settings, trial activity, disposition, sentencing, probation, restitution, appeal, transfer, or expunction activity. Not every case has each event. The chronology lists, in date order, what has actually been entered on the public record. That is what makes it useful.
Criminal docket flow: Filing or process › Arraignment › Pretrial or motion setting › Plea or trial › Disposition › Sentencing or later activity
An old Rutherford hearing entry is history, not proof a hearing is still set. To confirm the current setting, use Portal Search Hearings with a case number or name, a location, hearing type, search criterion, and date range.
Rutherford County Criminal Court Records
One office anchors the whole system. The Rutherford Clerk of Superior Court serves both trial divisions, so a Rutherford County court docket search starts there no matter which level holds the case. Rutherford Superior Court takes every felony and hears misdemeanor and infraction appeals from Rutherford District Court. The District Court, in turn, is the front door for most misdemeanor, traffic ticket, and infraction matters. Magistrates handle preliminary criminal functions, though the court offers no separate public magistrate docket system.
A criminal conviction in Rutherford District Court can move to Rutherford Superior Court for trial de novo. That means a fresh trial, not a review of the District Court transcript. Watch for Portal status labels such as Transferred to Superior Court, Appealed–Appellate, Trial De Novo, and Remanded. They explain why a case's record path or setting shifted. A Rutherford court record also stands apart from the later appellate docket kept by the North Carolina Court of Appeals.
NCAOC's county criminal and infraction activity reports give Rutherford County rows for filings, dispositions, pending cases, and outcomes.
The report landing page offers useful county-level context. Treat any Rutherford figure pulled from a spreadsheet download with care until it matches an official report row.
Courts That Hold Criminal Dockets
Every paper Rutherford County court record lives in one building. The Rutherford County Courthouse houses the Rutherford Clerk of Superior Court and both court levels' files at 229 N. Main St., Suite 203, Rutherfordton, NC 28139. Call the Clerk's main line at (828) 288-6100 for record or copy questions. Rutherford Superior Court routing is (828) 288-6116, and Rutherford District Court routing is (828) 288-6179 for setting questions about a specific court. Skip the prosecutor or magistrate lines; neither is a records office.
State guidance allows public self-service terminals in a Clerk's office for criminal, civil, special-proceeding, and estate information. Call ahead to confirm the file you want is open for paper inspection or terminal viewing. The official courthouse listing posts weekday hours of 8:30 a.m. to 5 p.m. and notes wheelchair access. The Rutherford contact directory lists the court-routing lines as well.
Rutherford County Criminal Docket Conversion
Rutherford County joined eCourts on October 13, 2025. The date came in the final statewide move to Enterprise Justice. That system is also called Odyssey. Portal became the public remote route for a docket search. File & Serve took over filing separately. Records and case-event data migrated out of legacy paper and mainframe processes, and that history explains oddities when an older entry sits beside a new Portal display.
One quirk matters for timestamps. Portal guidance says pre-go-live events were converted. So a pre-conversion event can show a 12:00 a.m. time. That is a conversion artifact, not proof of a midnight courtroom action. Read the date, the event description, and any order before trusting the time field.
The February 2025 Track 10 announcement laid out Rutherford's planned conversion date.
The rollout moved Rutherford's public criminal docket searches into the statewide Portal. No stand-alone county database took their place.
The final statewide rollout explanation describes the shift from legacy systems to the cloud.
That page gives system-wide context, while the current Case Summary and the Clerk remain the case-specific sources.
Sealed Dockets and Public Access
G.S. 7A-109 requires Clerks to keep prescribed files, dockets, and indexes open to public inspection. Access closes only when law blocks it. The free Portal view stops at public material and is not an authenticated record. Juvenile records stay off-limits under G.S. 7B-3000. Sealed or expunged records never appear through Portal. Protective orders, unreturned warrants, and similar sensitive categories can be restricted too. A blank result screen tells you nothing about which reason applies.
Public-access limit. A completed sealing or expunction order changes access. A request or a pending status does not establish that a Rutherford County criminal record has been removed from public view.
North Carolina’s juvenile-record statute explains the confidentiality boundary for juvenile matters.
That limit means a public criminal Case Summary will not expose juvenile material. G.S. 15A-145 is one expunction statute. Eligibility and filing rules still turn on whichever statute governs the particular record.
Questions about public access to one case belong with the Clerk or qualified legal counsel. Do not try to work around a restriction yourself.
Rutherford County Criminal Record Copies
The Clerk is the official custodian and the practical fallback. Turn there when a document is not public online. The Clerk also helps when a large download fails, or when you need an authenticated copy. In person, a public terminal and the county case file serve visitors at the courthouse. By phone, the Clerk's main line is (828) 288-6100. The office publishes no official copy-request email or fax and states no turnaround. Call before mailing anything. Note that the NCAOC public-record form covers agency-held records, not a Rutherford court file.
Fees come from G.S. 7A-308. The first copied page of each document costs $2, each additional page or fraction costs $0.25, and a certificate under seal is $3. Exemplification runs $10. A certified county criminal-record search costs $25 on form AOC-CR-314, and it covers only the named county's indices rather than the whole state. For a case document or Register of Actions, have the exact case number and document name ready when you call.
